Terms of Service

These Terms of Service ("Terms") govern your use of Common Realtor and any related services we provide (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

Important — not a real estate brokerage. Common Realtor is a real estate network and lead-generation platform. We are not a licensed real estate brokerage and we do not represent buyers or sellers directly. Any real estate transaction you enter into is facilitated by an independently licensed real estate professional or brokerage, and your relationship with that licensed party is governed by a separate written agreement between the two of you.

1. Who may use the Service

You must be at least 18 years old to create an account, submit a form, or subscribe as an agent or business owner. By using the Service, you represent and warrant that you meet this requirement.

2. Accounts

When you register as an agent or business owner, you agree to:

  • Provide accurate, current, and complete information.
  • Keep your account credentials confidential. You are responsible for all activity under your account.
  • Notify us immediately of any unauthorized use or security breach.
  • Not create accounts in someone else's name, impersonate others, or misrepresent your affiliation.

We may suspend or terminate any account at our discretion if these Terms are violated or if we have reason to believe the account is being used in a way that harms other users or the Service.

3. Subscriptions and payments

Agent memberships

Agents can join free on the Agent plan, or subscribe to a paid plan (Prime or Elite) for additional tools. Paid subscriptions are processed by Stripe and automatically renew at the billing interval you selected (monthly or annual) until you cancel.

Business listings

Businesses subscribe to the Local Spotlight or Featured Partner tier (or the Free tier, which carries no charge). Same auto-renewal rules apply to paid tiers. Business listings are reviewed by our team before appearing publicly; subscription does not guarantee approval, and we reserve the right to decline listings that don't meet our quality or content standards.

Cancellation

You may cancel your subscription at any time through your dashboard (which opens Stripe's self-service customer portal). Cancellation stops future renewals. Your listing remains visible until the end of the current billing period, after which it is automatically hidden.

Refunds

Subscriptions are generally non-refundable. We may, at our sole discretion, issue partial or full refunds in exceptional cases (e.g., duplicate charges, billing errors, or extended service outages affecting your listing). Contact us to request consideration.

Price changes

We may change subscription prices with at least 30 days' notice to active subscribers. Continued use after the effective date of a price change constitutes acceptance of the new price.

Agent commission and future fees

Today, agents on the free plan keep 100% of their commission, and Common Realtor charges no commission split and no referral fee; paid plans are a flat subscription and are not tied to your closings. These Terms are versioned (see the version at the top of this page), and we record the version each agent accepted and the date of acceptance.

We may modify these Terms and our fee structure prospectively. If we introduce a new or changed agent fee — for example, an optional success fee on certain plans — we will provide advance notice and post an updated, versioned copy of these Terms. Any new or increased fee applies only to leads you receive, or closings that occur, after you accept the updated Terms; it never applies retroactively to activity before then. A new agent fee will require your acceptance of the updated Terms before it applies to you.

4. Your content

"Your Content" means anything you post, upload, or submit through the Service — including agent or business profile text, photos, bio, business hours, descriptions, contact info, and form submissions.

  • You own Your Content. You grant us a worldwide, royalty-free, sublicensable license to host, display, reproduce, modify (for formatting or moderation), and distribute Your Content as necessary to operate the Service.
  • You are responsible for Your Content. You represent that you have the right to post it, that it is accurate, and that it does not infringe or violate anyone else's rights.
  • We may remove Your Content if we reasonably believe it violates these Terms or applicable law, or if we receive a credible complaint about it.

5. Leads and introductions

If you submit a contact, buy, sell, cash-offer, or inquiry form, you consent to us:

  • Sharing your contact information and message with one or more independently licensed real estate agents or participating business owners in our network whose service area or category is relevant.
  • Contacting you by email to acknowledge receipt and, occasionally, to follow up on your inquiry.

You are under no obligation to work with any introduced party. Any decision to engage an agent, brokerage, or business is solely yours.

6. Acceptable use

You agree not to:

  • Scrape, crawl, or copy the Service or its content without permission (except as permitted by our robots.txt).
  • Use the Service to violate any law, or to transmit harmful, defamatory, infringing, or fraudulent content.
  • Attempt to probe, penetrate, reverse-engineer, or otherwise compromise the security of the Service.
  • Interfere with other users' access or enjoyment of the Service.
  • Upload content you don't have the rights to (stolen photos, plagiarized text, etc.).

7. Third-party services

The Service integrates with third-party providers (Stripe, Google Maps, Cloudinary, RentCast, Resend/Gmail, etc.). Your use of those services is governed by their own terms. We are not responsible for third-party outages, data handling, or actions.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Specifically, we do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • Listings, property values, cash-offer estimates, or directory information will be accurate or current.
  • Agents or businesses in our directory will be available, licensed in good standing at the moment you contact them, or capable of providing any specific result.

Cash-offer estimates produced by the Service are automated valuations based on third-party property data and are not a binding offer to purchase. Any actual offer will come separately from a licensed buyer.

9. Limitation of liability

To the maximum extent permitted by law, Common Realtor and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim related to the Service is limited to the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) US $100.

10. Indemnification

You agree to indemnify and hold harmless Common Realtor and its affiliates from any claim, demand, or damages (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service in violation of these Terms, or (c) your violation of any law or third-party right.

11. Termination

You may stop using the Service at any time and cancel your subscription from your dashboard. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms.

Sections that by their nature should survive termination (including "Your Content," "Disclaimers," "Limitation of liability," "Indemnification," and "Governing law") will survive.

12. Governing law and disputes

These Terms are governed by the applicable laws of the United States and the state in which Common Realtor is organized, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in a court of competent jurisdiction, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll post the updated Terms on this page with a new "Last updated" date and, where appropriate, notify active subscribers by email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
